Welcome to the Australian School of Self-Defence (ASOSD) ("we", "us", "our"). These Terms of Use ("Terms") govern your access to and use of our website, services, and facilities. By accessing our website, booking a class, or engaging with our services, you agree to be bound by these Terms and all applicable Australian laws and regulations.
1. Services Provided
We provide martial arts instruction, self-defence training, fitness classes, seminars, and related services ("Services"), including in-person training, online courses, and merchandise sales. All Services are subject to these Terms.
2. Eligibility and Consent for Minors
Our Services are available to individuals of all ages. If you are under 18 years of age ("Minor"), you must have the consent of your parent or legal guardian to participate. By enrolling a Minor, the parent or guardian represents they have authority to do so and agrees to these Terms on the Minor's behalf.
3. Payments and Billing
All payments are processed securely through our third-party gateway, Stripe. By providing payment information, you authorise us to charge applicable fees to your selected method. You agree to provide accurate and current purchase information.
4. Intellectual Property
All content on this website and provided through our Services (text, graphics, logos, images, videos, course materials) is the property of ASOSD or its licensors and is protected by Australian and international copyright and trademark laws. Unauthorized reproduction or distribution is prohibited.
5. User Conduct
You agree to use our website and Services for lawful purposes only, and must not disrupt our operations. You agree to follow our code of conduct and the directions of our instructors during all training sessions.
6. Assumption of Risk and Limitation of Liability
While safety is our absolute highest priority (enforced via the S.A.F.E. system), participation in martial arts carries inherent risks of physical injury. By participating, you acknowledge and voluntarily assume all associated risks and confirm you are in good physical condition. To the maximum extent permitted by law, ASOSD and Grandmaster John Gill are not liable for any direct, indirect, or consequential damages arising from your participation.
7. Consumer Guarantees
Under the Australian Consumer Law, our Services come with guarantees that cannot be excluded. For major failures, you are entitled to cancel your contract and receive a refund for the unused portion. Nothing in these Terms restricts any right or remedy implied by law which cannot be excluded.
8. Indemnification and Modifications
You agree to indemnify and hold harmless ASOSD from any claim arising out of your breach of these Terms. We reserve the right to revise these Terms at any time; continued use of our Services constitutes acceptance of the new Terms.
